1. Who we are

This website, curbcuttersunlimited.com, is operated by CurbCutters Unlimited ("CurbCutters", "we", "us", "our"). We are a disability owned streetwear business selling apparel and accessories directly to customers. You can reach us at hello@curbcuttersunlimited.com and we aim to respond within 24 to 48 hours, Monday to Friday.

2. Agreeing to these terms

By browsing this site, creating an account or placing an order, you agree to these terms. If you do not agree with them, please do not use the site or buy from us. These terms apply alongside our Shipping and Returns policy and our Privacy Policy, which form part of this agreement.

3. Who can buy

You must be at least 18 years old, or old enough to enter a binding contract where you live, to place an order. If you are younger, a parent or guardian must make the purchase. By ordering you confirm the payment method you use belongs to you or that you have permission to use it.

4. Your account

You can order as a guest or create an account. If you create one, keep your password to yourself and tell us promptly if you think someone else is using it. You are responsible for activity under your account. We may suspend or close an account that is being used for fraud or abuse.

5. Our products

Our garments are made to order rather than held as stock. That is a deliberate choice to avoid overproduction, and it is why our processing times are longer than a warehouse operation.

• Product photography and mockups are representative. Colour can vary between screens, and between print runs and dye lots.
• Measurements are given as a guide. Where seated measurements are published, use those rather than sizing up.
• We describe access features as accurately as we can. If a feature matters to you, email us before ordering and we will answer honestly, including when the answer is no.
• We may change, improve or discontinue a product at any time without notice.

6. Prices, tax and currency

All prices are shown in United States dollars (USD) and exclude shipping and tax unless stated otherwise. Applicable sales tax is calculated and shown at checkout. We try hard to keep pricing accurate, but if a product is listed at an obviously incorrect price we may cancel the order and refund you in full rather than fulfil it. We will tell you if that happens.

7. Orders and acceptance

Placing an order is an offer to buy. The order confirmation email acknowledges that we received your order; it is not acceptance. The contract forms when we confirm your order has shipped. We may decline or cancel an order, including where a product is unavailable, where we suspect fraud, where a pricing or description error has occurred, or where we cannot ship to your location.

8. Payment

Payments are processed by our payment provider. Card details are entered on the provider's secure infrastructure and are not stored on our servers. By submitting payment details you confirm you are authorised to use that payment method, and you authorise us to charge the full order amount including shipping and tax. If a payment is declined or reversed we may cancel the order.

9. Shipping and delivery

We process orders within 2 to 4 business days. Standard shipping then takes 7 to 10 business days and expedited takes 3 to 5. Those windows are estimates, not guarantees, and carrier delays are outside our control.

We currently ship within the United States only. Risk of loss passes to you on delivery to the carrier, but if a parcel goes missing in transit, contact us and we will help you resolve it.

10. Returns, refunds and cancellations

Our products are made to order by third-party fulfilment partners, including Printful. Because each item is produced individually for you, we do not accept returns or refunds for a change of mind or for ordering the wrong size. The remedies available may also vary depending on which partner produced your item.

Approved refunds are issued to the original payment method. Because our products are made to order, an order can usually only be cancelled before production begins, so contact us quickly if you need to cancel.

If an item arrives damaged, faulty or is not what you ordered, email us within 30 days of delivery and we will replace it or refund it at no cost to you. Nothing in these terms limits your rights under consumer protection law where those rights apply.

11. Chargebacks

If something has gone wrong with your order, please contact us first. We would far rather fix it directly than have it become a dispute. We reserve the right to contest chargebacks raised without a prior attempt to resolve the issue with us.

12. Intellectual property

The CurbCutters name, logo, graphics, garment artwork, photography and site content are owned by us or used with permission, and are protected by intellectual property law. Buying a garment gives you the garment, not a licence to reproduce the artwork on it. You may not copy, resell, print or use our designs commercially without written permission.

13. Content you submit

If you send us a review, photo, or feedback, you keep ownership of it and grant us a non-exclusive, royalty free licence to use it in connection with the brand. Do not send us anything you do not have the right to share. We may remove content that is unlawful, abusive or misleading.

Where we work with disabled testers, riders and creators, that work is paid and covered by a separate agreement. This clause does not cover it.

14. Acceptable use

• Do not use this site for anything unlawful or fraudulent.
• Do not attempt to break, probe or overload the site or its security.
• Do not scrape, copy or republish the site or its content at scale.
• Do not harass our team, our collaborators or other customers.

15. Accessibility

Accessibility is part of the product and we hold the site to the same standard. If something on this site blocks you, tell us and it goes to the front of the queue. You do not need to explain or prove your disability to report a barrier.

16. Third party services

We rely on third parties for payment processing, production and fulfilment, shipping and analytics. Their handling of your information is governed by their own terms and privacy policies. Our site may link to other websites; we are not responsible for their content or practices.

17. Disclaimers

The site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error free. To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.

Our apparel is designed for everyday wear. It is not protective equipment and is not certified as personal protective equipment for any sport or activity, including adaptive action sports. Do not rely on it for impact, abrasion or crash protection.

18. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or in connection with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost profits or lost opportunity. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

19. Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the site, or your infringement of someone else's rights.

20. Governing law and disputes

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules. The courts of Florida have exclusive jurisdiction, except where consumer protection law in your country of residence gives you the right to bring a claim locally. Before starting any formal process, please contact us so we can try to resolve it directly.

21. Changes to these terms

We may update these terms as the business changes. The version published on this page at the time you place an order is the version that applies to that order. Material changes will be reflected in the effective date at the top.

22. General

If any part of these terms is found unenforceable, the rest continues to apply. A delay in enforcing our rights is not a waiver of them. These terms, together with our Shipping and Returns policy and Privacy Policy, are the entire agreement between us regarding your use of this site.
